These terms cover your use of the BP Pulse Log iOS app and the website bppulselog.com. Both are provided by Minigamr LLC ("we", "us"). "You" means the person using them.
Acceptance
By downloading or using BP Pulse Log, you agree to these terms. If you do not agree, please do not use the app.
Your license to use the app
BP Pulse Log is licensed to you, not sold to you.
We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use. You may not copy, sell, rent, or redistribute the app, and you may not reverse engineer it except where the law says you may.
Medical disclaimer
Read this section carefully. It is the most important part of these terms.
BP Pulse Log is a logbook. It records the numbers you type in yourself. It is not a medical device. It does not measure your blood pressure or your pulse, and it has no sensors of any kind.
The app does not diagnose anything. It does not treat anything. It does not give medical advice, and nothing in it is a substitute for advice from a qualified healthcare professional.
The app may show a category label next to a reading. Those labels reflect published blood pressure guideline bands. They describe one single reading that you entered, nothing more. They are not an assessment of your health, they are not a diagnosis, and a label alone should never drive a decision about your care. Blood pressure is judged by a clinician over multiple readings and in the context of your full medical history.
Always talk to your doctor or another qualified healthcare professional about your blood pressure, your readings, and your treatment. Never ignore professional medical advice, and never delay seeking care, because of something you saw in this app. Do not start, stop, or change any medication based on the app.
Emergencies. If your readings are very high, or if you have symptoms such as chest pain, shortness of breath, changes in your vision, or weakness, contact emergency services or get to emergency care immediately. Do not use this app to decide whether a situation is urgent.
Your responsibilities
You enter the data, so you are responsible for it. The app cannot tell whether a number is correct. If you type the wrong value, or read your cuff wrong, or log a reading under the wrong date, the app will store exactly what you gave it. Please check what you enter, especially before you share a report with a clinician.
You are also responsible for your own backups. Your readings live on your device only. If you lose the device, erase it, or delete the app, that data is gone and we cannot restore it. We hold no copy. If your records matter to you, export a PDF or CSV regularly and keep it somewhere safe.
Follow the instructions that came with your blood pressure monitor. Correct measurement technique is up to you and your cuff, not the app.
Intellectual property
The app, its design, its name, its logo, its text, and the website content belong to Minigamr LLC and are protected by copyright and other laws. These terms give you a license to use the app, not any ownership of it.
The readings and notes you enter are yours. We claim no rights in them, and since they never leave your device, we could not use them even if we wanted to.
No warranty
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that the app will be error free, that it will always be available, or that it will meet every need you have. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Minigamr LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the app. This includes loss of data, loss of records, and any health outcome connected to your use of or reliance on the app.
Where liability cannot be excluded by law, it is limited to the minimum amount the law allows, and in no case more than what you paid for the app.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
Termination
You may stop using the app at any time by deleting it from your device. That also removes its data. We may end this license if you use the app in a way that breaks these terms or the law. There is no account to close and nothing for us to shut off, because the app runs entirely on your device.
Changes to these terms
We may update these terms. If we do, we will post the new version on this page and change the effective date at the top. If you keep using the app after that, you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Utah, USA, without regard to its conflict of law rules. If you live somewhere with consumer protection laws that give you stronger rights, those rights still apply to you.
